HAUS OF MELLO · THE BEVERAGE HOUSE

Terms of Use

The terms that apply when you explore the Haus, send an enquiry or use a private Mello account.

Effective and last updated: 24 October 2026

1. About these terms

These terms apply to the HAUS OF MELLO website and its private team and ambassador areas. In these terms, “we”, “us” and “our” refer to the business operating as HAUS OF MELLO, The Beverage House; “you” refers to a website visitor or account holder.

By using the website, you agree to these terms to the extent permitted by applicable law. If you do not agree, please stop using it. These terms govern website use, not the full terms of an event booking, franchise purchase or ambassador arrangement. Those require a separate agreement.

Questions or requests about these terms can be submitted through our Contact page.

2. Responsible website use

You may browse the website and submit genuine enquiries for yourself or an organisation you are authorised to represent. Provide accurate information and only share personal information you are entitled to provide.

  • Do not impersonate another person, submit fraudulent requests or use the site for unlawful purposes.
  • Do not attempt to access another person’s account, private records or restricted team areas.
  • Do not interfere with the website, upload harmful material, harvest personal information or bypass access controls.
  • Do not use the brand or website content in a way that falsely implies our endorsement.

If you are under 18, a parent or legal guardian should assist with any request that could result in a contract. You must have the legal capacity and authority required to enter any separate commercial agreement.

3. Menus, prices and availability

Menus, prices, trading locations, availability and event information may change. We aim to keep information accurate, but website content may contain errors or become outdated. Please confirm the relevant details with us before relying on them for a booking or commercial decision.

A displayed price is not a personalised event quotation. Applicable service scope, travel, setup, payment and other booking conditions must be confirmed in the relevant quotation or agreement. Nothing in these terms permits misleading pricing or removes rights provided by law.

4. Enquiries and event bookings

Sending a contact, booking, host-location or franchise form is a request for discussion. An acknowledgement that your submission was received does not confirm a booking, reserve a date, accept a hosting arrangement or conclude a franchise agreement.

A booking is subject to availability and express confirmation under an agreed quotation or contract. Deposits, cancellation, rescheduling and refund conditions will be set out in that agreement and remain subject to applicable consumer law. These website terms do not introduce a blanket no-refund policy.

5. Collective and franchise enquiries

The Mello Collective is a community of ambassadors and professionals. An introduction is not an offer of employment, acceptance into the programme, a franchise allocation or a promise of work. Participation and commercial arrangements are subject to review and separate agreement.

Any franchise formats or investment ranges described as proposed or indicative are information for discussion, not a binding offer. Please obtain the relevant disclosure documents, final terms and independent advice before making a financial commitment.

6. Private accounts and access

Account registration does not automatically grant team or ambassador access. Access is assigned by the authorised team. Keep your sign-in details confidential, use your own account and notify us through the Contact page if you suspect unauthorised access.

Ambassadors may access the shared booking calendar and their own portal records; team administration remains restricted. Do not disclose other people’s information seen in the private calendar or portal. We may restrict access where reasonably necessary to address misuse, security risks or the end of an authorised relationship, without removing any lawful entitlement to records or payment.

7. Ambassador earnings and calendar

The team records event revenue and the applicable ambassador percentage. The portal displays the resulting earnings and transaction history. Report any discrepancy promptly so the team can investigate it; this website does not set a standard commission rate.

The total wallet balance combines Event Earnings and Franchise Contribution. Money can be moved between the two pockets. Withdrawal requests can only be made from sufficient Event Earnings; Franchise Contribution cannot be withdrawn directly. If necessary, move available money back into Event Earnings before requesting a withdrawal. Requests are reviewed by the team and paid using the bank details supplied; submitting a request is not confirmation of payment.

The wallet is a record of ambassador earnings and allocations, not an offer of a bank account or investment product. A Franchise Contribution balance alone does not award franchise rights. Those rights and any further financial terms require a separate agreement.

Pending calendar proposals do not reserve dates. Only administrators edit the calendar; an approved proposal is added to it and generates portal alerts for ambassadors. Calendar approval is not, by itself, a customer contract or an earnings entry.

8. Brand and content ownership

Our name, logos, original website text, designs and other content belong to HAUS OF MELLO or their respective owners and are protected by applicable intellectual property law. You may view content for personal use and use download or sharing features as intended. Other commercial reuse, reproduction or alteration requires permission unless permitted by law.

You retain ownership of material you submit. You permit us to use it only as needed to assess and respond to your request, administer an agreed relationship and meet lawful obligations, as described in our Privacy Policy.

9. External services and availability

The website may link to external services, including Instagram, WhatsApp, maps and sign-in providers. Their own terms and privacy practices apply when you use them. A link is not a guarantee of their content, availability or security.

Website and radio access may be interrupted for maintenance, connectivity or other reasons. We do not guarantee uninterrupted access. Music playback may depend on browser permission. Keep independent copies of information you need for your own records.

10. Liability and your legal rights

Use reasonable care when relying on general website information. To the extent permitted by law, we are not responsible for losses caused solely by matters outside our reasonable control or by your misuse of the website.

Nothing in these terms excludes liability that cannot lawfully be excluded, including liability for fraud or gross negligence, or limits any non-excludable rights under the Consumer Protection Act, POPIA or other applicable South African law. Any contractual liability for services is addressed in the relevant agreement, subject to those rights.

Please raise concerns through our Contact page so we can try to resolve them. This does not prevent you from approaching a competent regulator or court. These website terms are governed by South African law, subject to any mandatory law that applies to you.

11. Changes to these terms

We may update these terms as the website or services change. The date above identifies the current version. Changes do not retrospectively rewrite an existing booking or ambassador agreement, and material changes affecting an existing account relationship should be communicated appropriately.
